Clicredit gives credit to your project, and your satisfaction is our priority. Respect for your privacy and the protection of your personal data in accordance with applicable legislation are part of this commitment. We process your data to manage your credit and/or insurance in the best possible way and to offer you products and information perfectly suited to your needs.

Who is responsible for processing your data?

Clicredit srl (hereinafter referred to as “Clicredit”), whose registered office is located at Place Didier, 24 B37 B-6700 Arlon, and its Luxembourg branch is located at 10, Rue Michel Rodange L-2430 Luxembourg.

This Charter aims to inform you about the processing of your data. Clicredit acts as an intermediary in credit and insurance. The regulation regarding the processing of personal data only applies to individuals and persons representing a legal entity such as a company, a municipality, or an association. The regulation does not apply to the legal entity itself.

When Clicredit sends your file to a lender/insurer it collaborates with, the lender/insurer will act as the data controller, and Clicredit will act as a processor on behalf of the lender/insurer. For some of your personal data, Clicredit will remain the data controller even after the data is sent to the lender/insurer. This charter aims to inform you about the processing of your data.

What does personal data processing involve?

Personal data includes all information concerning an identified or identifiable individual. This could be a name, identification number, location data, online identifier, or any other information related to a person. The processing of personal data includes any possible operation on this data, such as collection, recording, use, or storage.

Clicredit processes your personal data for various purposes based on several legal grounds and ensures that only the necessary data is processed. You have no legal obligation to provide your personal data, but refusal may result in Clicredit being unable to establish or continue a relationship with you.

What personal data is processed?

  • Identification data: (e.g., name and surname, date and place of birth, ID card number, photo, nationality, IP address, etc.)
  • Contact data (e.g., postal address, email, phone number, mobile number, etc.)
  • Socio-demographic data (e.g., family situation, marital status, number of children, etc.)
  • Employment information (e.g., employer’s name, salary, type of employment, type of employment contract)
  • Banking, financial, and transactional data (e.g., bank account number, expenses and debts, claims, bank account details, assets, etc.)
  • Data related to your behaviors and browsing habits on Clicredit’s websites: consultation of information, simulations, requests, etc.
  • Geolocation data (precise location)
  • Data obtained from third parties: e.g., via a lender, consultation of the National Bank’s Central Credit Register for individuals, or external companies’ data such as lenders, insurance companies, reinsurers, which we use to complete and improve our records, etc.
  • Data collected via cookies. Cookies are essential for the proper functioning of our websites and the optimization of your visit. They serve various purposes: retaining your preferences, collecting statistical data, adapting site content and/or advertisements according to your needs. Cookies allow you to access personalized pages automatically without having to log in and recognize your revisits.
  • Any other information or data necessary for establishing or continuing our client relationship.

Clicredit does not process sensitive data such as racial or ethnic origin, political, philosophical, or religious opinions, union membership, or data related to sexual life or genetics.

When do we collect your data?

We collect your data when you contact Clicredit, for example, by phone, via one of our websites, via one of our partners, or when you visit one of our offices.

Why does Clicredit process your data?

We collect personal data as part of our credit and insurance intermediation activities, both online and offline. This includes, for example, submitting a credit/insurance application or communicating with us or visiting and using our websites.

We collect this data notably for:

  • Managing your client file
  • Assessing financial situations and repayment capacity, consumer solvency
  • Granting, concluding, managing, and executing credits and services
  • Combating over-indebtedness
  • Fulfilling pre-contractual information obligations

On what legal grounds does the processing of your data rely?

Clicredit processes your personal data only in one of the following cases:

  • With your consent
  • When you have given your consent to a third party (e.g., a garage to transmit your personal data to Clicredit)
  • To comply with a legal or regulatory obligation
  • To fulfill and execute a contract with you or take pre-contractual measures at your request
  • On the legal basis of “legitimate interest”, we take all necessary steps to maintain a balance between Clicredit’s interests and yours, including the protection of your privacy.

Please note that under no circumstances may your personal data be transferred outside the European Union.

What are your rights, and how can you exercise them?

  • Right of access
    You can obtain information regarding the processing of your personal data and receive a copy of that data.
  • Right to object
    You may object at any time to the use of the data we collect, store, and process for reasons related to your particular situation. You have an absolute right to object to the processing of your personal data for direct marketing purposes, including profiling related to direct marketing.
  • Right to rectification
    If you believe your personal data is inaccurate or incomplete, you can request that this data be amended accordingly.
  • Right to erasure
    You can request the deletion of your data, particularly if:
    • The data is no longer necessary for the processing purposes
    • You withdraw your consent, and there is no other legal basis for the processing
    • You object to the processing
    • The data has been unlawfully processed
    • The data must be deleted to comply with a legal obligation.

However, the right to erasure is not absolute and can be refused under certain conditions.

  • Right to restriction of processingIn certain cases, you have the right to request a restriction on the processing of your data.
  • You can also request that some of your data be directly transferred to you or to a third party when technically possible.

    Right to Withdraw Your Consent

    If you have given your consent to the processing of your personal data, you have the right to withdraw this consent at any time.

    You are responsible for the accuracy and updating of your data. Therefore, please notify us in a timely manner of any changes, such as a change of address, marriage, divorce, contact information, etc.

    How Long Are Your Data Retained?

    This depends on the type of data and the regulations (e.g., anti-money laundering regulations). Your data will never be retained longer than necessary for the purpose for which it was collected. We retain your personal data for the longest period necessary to comply with applicable legal and regulatory provisions or for another period considering operational constraints, such as effective customer relationship management and responses to legal or regulatory requests.

    Retention periods are determined on a case-by-case basis, but generally, your data will be kept for 10 years after the end of the contract you concluded with the lender/insurer for which we act as a credit/insurance intermediary, or 3 years after your credit/insurance request if no contract is concluded via our intermediation with a lender/insurer we collaborate with.

    What Happens if the Privacy Charter Is Modified?
